The terms of the Education Facility’s enrolment, fees and cancellation form these terms and conditions which constitute a legally binding contract (“the Contract”) between you (“the Student”) and TESA Directive Pty. Ltd. (“the Education Facility”).
Enrolment of a Student on a course is subject to the payment of all outstanding monies owed by the Student to the Education Facility.
In order to enrol in any of the courses offered by the Education Facility, the Student must:
be fluent in English and must meet any English proficiency requirement specific to the course; and
be at least 15 years of age at the beginning of the course, unless otherwise specified in the course outline; and
provide evidence of the successful completion of any pre-requisite course where applicable; and
meet any other course specific requirements.
Fees
All course enrolments should be accompanied with:
a non-refundable registration fee of $100.00 AUD + GST which will be deducted from the total course fees; and
a completed registration form.
A deposit of 30% is payable within 7 days from date of quotation to secure the Student’s place within the course. The balance of fees are payable 30 days prior to the start date of the course. An invoice can be provided prior to payment upon request.
The Student will notify the Education Facility immediately of any circumstances that may prevent the payment of fees on time.
The Student is liable for the cost of any bank or transaction charges related to payment of fees. All credit card payments via AMEX will be subject to a transaction charge of 1.6% to cover bank charges.
The Education Facility reserves the right to increase course fees at any time prior to the start of the course. The price of any course will be that ruling on the day of the Student’s enrolment at which time the first payment is made by the Student.
The Education Facility will not reimburse fees in full or part if the Student:
is excluded from the Education Facility for any reason; or
does not attend the course without advising the Education Facility prior; or
fails to complete the course.
The Flexi Fee add on is subject to the following terms:
The Flexi Fee add on is non-refundable. All course fees are eligible for refunds subject to these terms and conditions.
All Flexi course enrolments will be eligible for one course date transfer free of charge.
All Flexi course date transfer requests must be made in writing and all forms must be submitted to the Education Facility prior to beginning the of course.
A Flexi course transfers are valid only for the course originally booked unless transferring into a course of equivalent or greater value. The Student must pay all additional course fees if they have chosen to transfer into a course of greater value.
All Flexi course purchases are valid for 12 months from the start date of the original enrolled course (based on scheduling).
Cancellation
Any course cancellations made by the Student must be made in writing to the Education Facility.
The following cancellation terms apply if the Student wishes to withdraw from the course:
The Student provides the Education Facility with notice 6 weeks or more prior to the commencement of a course, the Education Facility will provide a refund of any payments made in excess of any registration fee.
The Student provides the Education Facility with notice 21 days or more prior to the commencement of a course, the Education Facility will provide a full credit to the Student.
The Student provides the Education Facility with notice between 20 – 14 days prior to the commencement of a course, the Education Facility will credit any payments made in excess of any registration fee and retain an administration fee totalling 20% of the total course value per student.
The Student provides the Education Facility with notice 13 – 7 days prior to the commencement of a course, the Education Facility will credit 50% of any payments made in excess of any registration fee and retain the remaining 50% of tuition fee.
Where less than 7 days notice prior to the commencement of a course is provided by the Student, the Education Facility will retain 100% of the tuition fee paid.
Where a Student provides the Education Facility with less than 7 days notice prior to the commencement of a course due to extenuating circumstances, the Education Facility may, at their discretion, allow a re enrolment if the Student can provide evidence to support their claim of extenuating circumstances within 7 days. In these instances, a re enrolment fee of $150.00 AUD + GST will be applicable and payable within 7 days of evidence being provided. Failure to provide evidence within 7 days will result in the Student forfeiting 100% of the tuition fee paid
Withdrawal from a course, by the Student, after the commencement date will result in all fees paid being retained by the Education Facility.
Where the Student is not admitted to the course due to tardiness, the Education Facility will retain 100% of the tuition fee paid or offer a 50% credit note at its discretion.
The Education Facility reserves the right to cancel, postpone or re-schedule any course.
In any instances where the course is cancelled, postponed or re-scheduled by the Education Facility, the Student will be provided with a credit note for a future course of the same or lesser value, or a full refund if the Education Facility cannot provide the same course to the Student within a 12 month period.
All credit notes provided by the Education Facility will be held for 12 months from the date of issue.
The Student forfeits their credit note if they choose to cancel a course they have enrolled into utilising a credit note, irrespective of the date of expiry noted on the credit note.
Deferment
Any course deferrals by the Student must be made in writing to the Education Facility.
All deferral applications will be approved on a case by case basis with the information provided.
If approved the Student may only defer to the next available equivalent course unless opting to enrol into a course of greater value, in which case the deferral may be taken any time within 6 months with the credit amount applied.
If the Student is electing to transfer their deferral into a course of greater value, the Student must pay all additional course fees 21 days prior to the course commencement date. Failure to do so will result in the Student forfeiting all tuition payments made to the Education Facility.
The balance of any course fees outstanding for the course the Student is deferring into must be paid in full 21 days prior to the course commencement date. Failure to do so will result in the forfeit of the course deferment credit.
The following deferral terms apply if the Student wishes to defer their course:
If a deferral request is received by the Education Facility between 13 – 7 days prior to the course commencement date the Student will be credited 50% of any payments made less the administration fee.
If a deferral request is received by the Education Facility less than 7 days prior to the course commencement date the Student will be credited 25% of any payments made less the administration fee.
No deferral requests received by the Education Facility less than 24 hours prior to the course commencement date or on the course date will be approved unless evidence of extenuating circumstances can be supplied by the Student to the Education Facility.
Where the Student wishes to defer their course but provides the Education Facility with less than 7 days notice prior to the commencement of a course due to extenuating circumstances, the Education Facility may, at their discretion, allow a re enrolment if the Student can provide evidence to support their claim of extenuating circumstances within 7 days. In these instances, a re enrolment fee of $150.00 AUD + GST will be applicable and payable within 7 days of evidence being provided. Failure to provide evidence within 7 days will result in the Student forfeiting 100% of the tuition fee paid.
Courses
The Education Facility reserves the right to:
Make amendments at any time to the syllabus, educators, timing and any other details of a course as deemed necessary.
allow course educators, at their discretion, to refuse admittance to any Student who arrives late to the course in excess of 2 hours from the commencement of the course time.
Record, via photographs, video and/or audio, course learning sessions for quality assurance, educator evaluation and marketing purposes. If the Student does not wish to be partake in the above recorded sessions please provide a written statement advising the Education Facility.
To provide student contact information onto the suppliers sponsoring or visiting the course. Information that will be passed on will include, Student Name, Company Name, Email, State and Phone Number as provided on the enrolment form. If you do not wish for this information to be provided to our affiliated suppliers please provide written notice advising the Education Facility of this.
The Student agrees to the following when conducting training at the Education Facility:
they will arrive to the course 15 minutes prior to the commencement of the course. Where the Student is aware they may not arrive on time they are required to notify the Education Facility.
they will conduct themselves in professional manner at all times ensuring they are respectful of all students throughout their training at the Education Facility.
The Education Facility agrees to the following when providing training to the Student:
provide a safe learning environment for the Student; and
will accommodate late attendances whenever practicable at the discretion of the course educator; and
provide the Student details of any amendments to the syllabus, educators, timing and any other details of a course where these changes will affect their attendance.
Course Guides will be provided to the Student at the beginning of the course.
Attendance
It is mandatory that the Student attends the scheduled course they have enrolled in in its entirety, this applies to single day courses, several day courses and night school.
Where the Student does not meet the attendance requirements they understand they forfeit all rights to monies paid and are not entitled to any make up classes.
The Student agrees they will arrive to the course 15 minutes prior to the commencement of the course. Where the Student is aware they may not arrive on time they are required to notify the Education Facility to avoid possible exclusion from the course.
Certificates and Awards
The Education Facility will provide a certificate to the Student upon successfully passing the required examination for all applicable courses.
The Education Facility will provide any additional certificates or will reissue a certificate, on applicable course, at a later date up to 5 years after the initial date of issue, at an additional fee payable up front by the Student.
The Education Facility reserves the right not to award a certificate if:
the Student does not reach the minimum pass mark for the course; or
the Student is absent for any reason for more than 10% of the course.
Cheating and Plagiarism
The Education Facility maintains a zero tolerance policy on cheating and plagiarism. Any student found to have cheated or plagiarised in any way on their final examination will be reported to the external association responsible for that examination and have any results withheld.
The Education Facility will attempt to minimise the opportunities for deliberate or accidental cheating and/or plagiarism.
The Education Facility will ensure all claims of cheating and plagiarism are investigated appropriately and discreetly, ensuring the Student is respected at all times.
All investigations into cheating and plagiarism will take into account the level of intent to deceive when determining penalties.
Penalties for cheating or plagiarising will vary and may include a warning, a finding on their examination result withheld. Repeat offenders may find themselves excluded from any further courses run by the Education Facility to ensure the integrity of all other Students sitting the courses.
Behaviour, Health and Safety
To protect the safety and well-being of students the Education Facility is committed to maintaining a drug and alcohol free environment. The Education Facility prohibits the use, distribution, selling or possession of drugs or alcohol on the Education Facility premises.
The Education Facility reserves the right to immediately expel from the premises anyone found to be using, distributing, selling, in possession of or impaired by drugs or alcohol.
The Student forfeits all monies paid in an instance where they have been expelled for drug or alcohol impairment.
The Student is expected to behave respectfully towards staff and other students at all times. The Student agrees to ensure their behaviour does not disrupt or encroach on the learning of others while training at the Education Facility.
The Student is expected to follow the instructions of the educator at all times to ensure the safety and enjoyment of all others.
The Student is expected to take personal responsibility for their behaviour and actions and agree to avoid dangerous behaviour and encourage others to avoid dangerous behaviour.
The Student will handle all equipment provided for use throughout their time training at the Education Facility with care and will do their utmost to ensure follow instructions and prevent any damage occurring.
The Student will ensure their behaviour does not put themselves or any others at risk while training at the Education Facility.
The Student acknowledges that if the Education Facility is required to contact an ambulance for the Student, all associated Ambulance costs will be the responsibility of the Student and the Education Facility will not be held liable for any of these associated costs.
The Student acknowledges that they and/or their Company are prohibited from soliciting any other Students, the Trainers or the Education Facility Staff for any recruitment for the purpose of employment or personal commercial interests while training at the Education Facility.
Exclusion
The Education Facility reserves the right to exclude the Student either permanently or temporarily from the Education Facility if:
it has reason to believe the Student poses a risk to other students or staff; or
the educator deems the Student’s behaviour to be inappropriate or disruptive; or
the Student is persistently in breach of these terms and conditions; or
the Student has misled the Education Facility in their enrolment process; or
the Student does not meet the course’s specific attendance requirements; or
the Student arrives late to the scheduled course (exclusion will be at the trainer’s discretion); or
the Student is found to have cheated or plagiarised in any way on their final examination; or
the Student has been found to have cheated or plagiarised on multiple occasions with respect the examinations provided by the Education Facility; or
the Student is found to be impaired by drugs or alcohol; or
the Student’s fees are overdue.
the Student and/or their Company is found to be soliciting any other Students, the Trainers or the Education Facility Staff for any recruitment for the purpose of employment or personal commercial interests while training at the Education Facility.
any student is discovered to be recording, via photographs, video and/or audio, online or face to face course learning sessions.
The Student agrees that if they are excluded from the Education Facility and/or course for any of the above reasons, they forfeit all monies paid for the course they are enrolled into.
Limit to liability
The Education Facility shall not be liable for:
the cost of any airline tickets, accommodation charges or any other monies lost by the Student resulting from a course cancellation, postponement, re-schedule or venue change made by the Education Facility. It is strongly recommended the Student arrange travel insurance if they are attending courses in a location where any of the above is required for them to attend the course.
any loss of personal property; or
the consequences of events beyond its reasonable control; or
any indirect or consequential losses or loss of profits incurred by the Student; or
the failure by the Student to gain employment in the workplace upon the completion of the course.
Copyright
All materials provided during the course, including but not limited to course manuals and training methods, are subject to copyright and are provided by the Education Facility on behalf of our educators and relevant education bodies, associations and certification boards.
The Student will not provide any copyrighted materials to any other person.
General
These terms and conditions set out all the contractual terms agreed between you and the Education Facility.
No failure or delay by the Education Facility in enforcing any of its rights under the Terms and Conditions shall be deemed to be a waiver of such right.
These terms and conditions are subject to change at any time.
All prices quoted in these terms and conditions are exclusive of GST.
Under no circumstances can students and/or businesses record, via photographs, video and/or audio, online or face to face course learning sessions.
Promotions and special offers
Promotional fares may be subject to separate terms and conditions, where terms and conditions do not line up promotional fare terms and conditions will prevail.
Promotional fares are only available to claim within the specified times, and quantities of the promotion and are only redeemable on public courses.
Promotional discounts cannot be used on any order that has already been placed or in conjunction with any other discounts or offers, this includes but is not limited to, credit notes and vouchers.
Promotional fares may require a minimum upfront deposit, deposits paid on promotional fares are non-refundable, non-transferable, not for resale and not redeemable for cash. Promotional fare deposits will not be credited should you cancel or defer your course enrolment.
Promotional fares are available to new and existing customers across all states and territories.
The Education Facility reserves the right to withdraw, amend or cancel a discount offer at any time.
